Consumer Rights

CLC has been at the forefront of consumer rights’ litigation with several group litigation cases on behalf of consumers to its name. CLC has brought together consumers in off-plan purchases who have been left without completed apartments. It has secured a significant win on appeal in a land-banking case: Terracorp Limited v Rajesh Mistry and others [2020] EWHC 2623 (Ch).

CLC regularly litigates cancellation rights, implied terms under the Consumer Rights Act and Unfair Contract Terms Act.

CLC has supported businesses through CMA investigations. It has drafted consumer contracts for businesses, standard terms and conditions and has advised upon website and off-premises selling. It has rolled out contract management systems and policies for PLCs where consumers are at the heart of their model.

CLC offers its In-house Counsel Service to businesses that do not have lawyers and are seeking regular tailored advice and drafting solutions with consumer rights, contract cancellation, data protection, trading standards and compliance

Helen Swaffield is a regular contributor to BBC Radio 4’s “You and Yours” consumer rights programme and is a lecturer in B2C contracts.
